Enforcement and Removal Operations (ERO) Boston arrested a Brazilian illegal immigrant after he was released back into the community by a local court.

According to ERO Boston, a court in Worcester ignored a U.S. Immigration and Customs Enforcement (ICE) immigration detainer and released the unlawfully present noncitizen.

“When local jurisdictions ignore immigration detentions, they increase the threat to community residents,” said Todd M. Lyons, director of the ERO Boston Field Office. “This individual was subsequently arrested and charged with serious crimes; Yet the local jurisdiction refused to honor our prisoner and released him to possibly reoffend. ERO Boston will continue to prioritize public safety in our New England neighborhoods.”

U.S. Border Patrol arrested the Brazilian national in March 2019 after he unlawfully entered the U.S. near Santa Teresa, New Mexico. Border Patrol released him on recognizance after serving a notice to appear before a Department of Justice (DOJ) immigration judge.

In October 2022, the man was arrested and charged in Danbury, Connecticut, with misdemeanor charges of criminal trespass and breach of the peace. He was being held at the Bridgeport Correctional Center in Bridgeport, Connecticut, pending extradition to Massachusetts.

ERO Boston filed an immigration detainer complaint against the Brazilian national at the Bridgeport Correctional Center on October 24, 2022.

On October 26, 2022, following his extradition to Massachusetts, the Brazilian national was charged in Worcester District Court with assault with a dangerous weapon, possession of a firearm, ammunition without a firearm identification card, and discharging a firearm within one mile. of a home.

He was being held at the Worcester House of Correction.

ERO Boston filed a new warrant against the man at the Worcester House of Correction on October 31, 2022.

“Despite the existence of an active immigration detainer issued by ERO Boston, the Brazilian national was released from the Worcester County House of Corrections on an unknown date. ERO Boston received no notification of his release back into the community,” ICE said.

On April 5, 2024, ERO Boston deportation agents arrested the 21-year-old man without incident in Worcester, Massachusetts. He will be held in ICE custody pending a future hearing before an immigration judge

“As part of its mission to identify and apprehend removable noncitizens, ERO conducts immigration detentions against noncitizens who have been arrested for criminal activity and taken into custody by state or local law enforcement,” ICE said. “An immigration detainer is a request by ICE to state or local law enforcement agencies to notify ICE as soon as possible before releasing a removable noncitizen from their custody. The detainees request that state or local law enforcement agencies hold the nonresident in custody for a period of up to 48 hours beyond the time the person would otherwise be released, allowing the emergency response agency to take custody for removal purposes in accordance with federal law. ”
