New Delhi: The Delhi High Court has rejected the bail plea of ​​an accused in a UAPA case related to the alleged conspiracy behind the 2020 communal riots, saying a violent public demonstration goes beyond the constitutional right to protest and becomes a crime punishable by law. Justices Suresh Kumar Kait and Manoj Jain, in an order uploaded on Tuesday, said there was sufficient material to indicate that accused Salim Malik, who had allegedly incited locals in the name of religion, was involved in a “deep-rooted conspiracy ‘. “During the meetings held on 20/21 February 2020 at Chand Bagh and again on 22/23 February, which were attended by the appellant along with other accused, the aspects relating to riotous violence and burning of Delhi were openly discussed. is not acceptable in any democratic nation,” the bench said, adding: “There were also discussions on finance, arranging arms, procuring petrol bombs for killing people and burning of property and destruction of CCTV installed in the area”. Based on facts and statements of witnesses, the court concluded that the allegations against the accused constituted a prima facie case against him, for which the bail granted under Section 43-D(5) of the UAPA was imposed . Senior advocate Salman Khurshid, appearing on behalf of Malik, had argued that no case had been filed against him under the UAPA. But the prosecution alleged that Malik, a resident of Chand Bagh, had actively participated in the riots.
