Spar: cases filed against 2 million years for ‘hate speech’: state against Hc | Mumbai News

Mumbai: The public prosecutor on Tuesday informed the Bombay High Court that police have registered criminal cases against BJP MLA Nitesh Rane for alleged hate speech in Malwani, Mankhurd and Ghatkopar earlier this year. A first information report (FIR) has also been registered against MLA Gita Jain for an alleged hate speech at Mira Bhayander between January and March this year. The FIRs invoke Section 153A of the Indian Penal Code (IPC) (promoting enmity between groups on grounds of religion). etc.), 504 (intentional insult with intent to provoke) and 506 (criminal intimidation), among others. Public prosecutor Hiten Venegavkar informed a division bench headed by Justice Revati Mohite Dere that a total of 13 cases had been registered in connection with violence in Mira Road between January 22 and 26. The bench, which also included Justice Manjusha Deshpande, directed the state to file an affidavit detailing the cases and steps taken by June 12. HC will next hear on June 19 a petition filed by residents including Aftab Siddiqui, Ashfak Shaikh and three others, including two who claimed to be victims of violence. Senior counsel Gayatri Singh, Vijay Hiremath and advocate Hamza Lakdawala for the petitioners had questioned lack of police action against the alleged hate speeches, citing Supreme Court orders of 2022 and 2023 directing all states and union territories to take suo motu action against hate speeches to preserve India’s secular character. Venegavkar said investigation has begun and the police commissioners will decide whether IPC Section 295A (intentional and malicious intent to incite religious sentiments) should be invoked. HC had earlier directed Mumbai Police chiefs and Mira Bhayander to review the voice tapes and transcripts along with the public prosecutor and indicate whether FIRs would be registered and also directed to maintain law and order at Ram Navami in the city.
